Terms of Service

The agreement

These terms are an agreement between The Truck Desk LLC, a Georgia limited liability company doing business as TruckDesk (“TruckDesk”, “we”), and the business on whose behalf you create an account (“you”, “your company”). By creating an account or using the service you accept them. If you are accepting for a company, you represent that you have authority to bind it. TruckDesk is a business tool. You must be 18 or older and using it for business purposes.

The service

TruckDesk is accounting software for small trucking fleets: driver settlements, bookkeeping, invoicing, IFTA figures, and related back-office tools, including optional connections to your bank accounts (via Plaid), your ELD (such as Motive), and AI-assisted document processing. The Privacy Policy describes how data moves through the service and is part of these terms.

TRUCKDESK IS SOFTWARE, NOT AN ACCOUNTING FIRM, TAX PREPARER, OR LAW FIRM. NOTHING IN THE SERVICE (INCLUDING COMPUTED SETTLEMENTS, IFTA FIGURES, REPORTS, CATEGORIZATIONS, OR ANY CONTENT WE PUBLISH) IS TAX, LEGAL, OR ACCOUNTING ADVICE, AND NO PROFESSIONAL-CLIENT RELATIONSHIP IS CREATED BY USING IT. THE SERVICE COMPUTES RESULTS FROM THE DATA YOU AND YOUR CONNECTED SOURCES PROVIDE. YOU ARE RESPONSIBLE FOR REVIEWING ALL OUTPUTS AND FOR THE ACCURACY, FILING, AND PAYMENT OF YOUR TAXES AND RETURNS, INCLUDING IFTA. Your account

  • Keep your credentials secure; you are responsible for activity under your company’s accounts, including staff you add and driver portal links you distribute.
  • Provide accurate information and keep it current.
  • Notify us promptly at support@thetruckdesk.com if you suspect unauthorized access.

Your data

Your company’s data is yours. You grant us the limited license needed to host, process, transmit, and display it in order to provide the service, and nothing more. You are responsible for having the right to put data into TruckDesk: in particular, for driver records (including DOT medical certificates, drug-and-alcohol test results, and similar employment records), you confirm your company complies with its obligations to its drivers and applicable record-keeping rules. You can export your data at any time (CSV exports in-product; fuller exports on request).

Third-party connections

Bank connections are provided through Plaid under Plaid’s terms and privacy policy. ELD connections use API credentials from your own account with the provider (for example, Motive), and you authorize us to retrieve your fleet’s data with them. Third-party services are governed by their own terms, and an interruption on their side (a bank feed, an ELD API) is outside our control. Statement and document extraction is AI-assisted; you review extracted data before it enters your books, and you are responsible for what you approve.

Plans, trials, and billing

Paid plans and prices are listed at thetruckdesk.com/pricing. New accounts start with a 14-day free trial. While self-serve billing is being finished, subscriptions are invoiced and collected directly and plan changes are handled by us on request, prorated. We may change prices with at least 30 days’ notice, effective at your next billing cycle. If an account becomes delinquent we may suspend it after notice; your data remains exportable during suspension.

Acceptable use

  • No unlawful use, and no storing data you have no right to hold.
  • No probing, disrupting, or circumventing security or tenant isolation.
  • No reselling, sublicensing, or offering the service to third parties as your own.
  • No reverse engineering except where the law grants that right regardless of contract.

Availability

We work to keep TruckDesk available and fast, but the service is provided without an uptime guarantee and may be briefly interrupted for maintenance or by our providers. We are a small company and tell you honestly: back up your exports for records you cannot afford to lose.

Intellectual property

The software, site, brand, and everything we built remain ours; these terms grant you use, not ownership. Feedback you send us may be used to improve the product without obligation.

Termination

You may stop using the service and close your account at any time by emailing support@thetruckdesk.com. We may suspend or terminate accounts that violate these terms or create risk for other customers, with notice where practicable. After termination we will make your data available for export for 30 days, after which we may delete it (see the Privacy Policy for deletion details). Sections that by their nature survive (data ownership, disclaimers, liability limits, governing law) do survive.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT COMPUTED RESULTS WILL BE ACCURATE WHERE THE UNDERLYING DATA (YOURS OR A CONNECTED PROVIDER’S) IS INCOMPLETE OR INCORRECT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (1) NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA; AND (2) TRUCKDESK’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE IS CAPPED AT THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU HAVE PAID NONE. THESE LIMITS DO NOT APPLY WHERE THE LAW PROHIBITS LIMITING THEM.

Indemnification

You will defend and indemnify TruckDesk against third-party claims arising from your data, your use of the service in violation of these terms, or your company’s obligations to its own drivers, customers, or tax authorities.

Governing law

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Georgia, whose jurisdiction both parties accept.

Changes to these terms

Announced August 20, 2026, effective September 3, 2026: the service is now provided by The Truck Desk LLC, a Georgia limited liability company, and these terms are governed by Georgia law rather than Florida law. Nothing else changed. Until September 3 the previous version governs; the fourteen days between the two dates are the notice this section promises.

We may update these terms; material changes will be announced by email or in the product at least 14 days before they take effect. Continued use after the effective date is acceptance. The date at the top is always current.
